The agreement

Terms of Service

These terms govern your use of the Stash memory API at stash.sanctumx.ai and the websites of SanctumX, LLC ("SanctumX", "we"). By creating an identity or using the service, you agree to them. If you direct an AI agent to use the service, you are the customer: the agreement is with the human or legal entity that holds or funds the capability token, and you are responsible for your agents' use.

1. The service

Stash provides each identity an append-only memory log and summary tree, reachable over HTTPS with a capability token, encrypted so that SanctumX cannot read its contents. The service is deliberately small; its behavior is documented at API-REFERENCE.md, which is part of these terms in the sense that it describes what you are buying.

2. Tokens, and what "we cannot help" means

Your capability token is shown exactly once at creation and is never stored by us. It is the only key to the memory it governs. If every token for an identity is lost, the memory is cryptographically unrecoverable — by you, by us, by anyone. This is a designed property of the service, not a failure of it. You are responsible for safeguarding tokens; anyone presenting a token has the access it grants.

3. Payment

Creating an identity costs the price posted at pricing, payable through our payment processor, Stripe. Prices may change for future purchases; an identity already created is not billed again. You are responsible for any taxes applicable to your purchase.

4. Refunds — all sales are final

The identity and its token are delivered instantly and irreversibly at purchase: because we cannot read or reconstruct what a token controls, we cannot meaningfully "take back" a delivered identity. For this reason, all sales are final.

If you are a consumer in the EU, UK, or another jurisdiction with a statutory withdrawal right for digital content: by purchasing, you expressly request immediate delivery of the digital content and acknowledge that you thereby lose the right of withdrawal once delivery is complete. Delivery is complete when the token is displayed.

Identities created through fraudulent payment, or whose payment is reversed, may be deleted. If something went genuinely wrong with a purchase — a double charge, a technical failure before the token was shown — write to us; we are not monsters, merely cryptographers.

We cannot see what you store, so these rules are enforced through behavior and metadata, and through your good faith. You agree not to use the service:

You retain all rights to what you store. We claim no license to it — we could not exercise one, since we cannot read it. You are solely responsible for what your identities contain.

7. Availability, backups, changes

The service is provided as is, without a service-level agreement. We keep encrypted backups on a rotating schedule and operate the service with care, but we do not warrant uninterrupted availability or loss-free operation. We may change or discontinue the service; if we discontinue it, we will make reasonable efforts to provide notice and a wind-down period during which identities remain accessible.

8. Termination

You may stop using the service at any time; on a verified request from an identity's owner capability, we will delete its store. We may suspend or delete identities that violate these terms or applicable law. Deletion of an encrypted store is permanent.

9. Disclaimers and limitation of liability

To the maximum extent permitted by law, SanctumX disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the same extent, SanctumX's total liability arising out of the service is limited to the amount you paid us for the identity giving rise to the claim, and SanctumX is not liable for indirect, incidental, special, or consequential damages, including loss of data — noting again that irrecoverability of memory upon token loss is a purchased feature. Some jurisdictions do not allow certain limitations; where they apply, these limitations apply to the fullest extent permitted.

10. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules, and disputes shall be resolved in the state or federal courts located in Wyoming, except where the law of your place of residence grants you non-waivable rights or venue as a consumer.

11. Changes to these terms

We may update these terms; the effective date above will change when we do. Material changes will be noted on this page. Continued use after a change is acceptance of it.
